1. Agreement Overview

These Terms of Service (“Terms”) govern your access to and use of the AgriTruck Supply website, product orders, and related services (collectively, “Services”). By browsing, placing an order, or contacting us, you agree to be bound by these Terms. If you do not agree, please refrain from using our Services. These Terms constitute a legally binding agreement between you (“Client”, “Buyer”) and AgriTruck Supply (Shandong Jinan based entity, “Company”, “we”, “us”).

2. Orders & Customizations

All product descriptions, specifications, and pricing are subject to change without notice. We reserve the right to refuse any order. Custom orders (tractors, harvesters, processing machines, etc.) require written confirmation and 30% deposit. Once production begins, no changes or cancellations are permitted, as machinery is built to your exact specifications. The Client is fully responsible for verifying technical requirements before order confirmation.

3. Return Policy & Factory Confinement

Our return policy is strictly defined and limited: Returns are only supported for products that remain within the confinement of our factory premises in Jinan, China. Once a product has left the factory — including for shipping, export, or delivery — it is considered non-returnable and non-refundable. This includes:

• Any machinery shipped via sea, air, or land freight.
• Custom-manufactured equipment (tractors, planters, sprayers, packaging machines).
• Products paid in full and scheduled for dispatch.
• Spare parts, accessories, and consumables.

After delivery, we provide 24/7 technical support, spare parts sourcing, and remote troubleshooting at no extra cost (shipping fees for parts may apply). However, no refunds or product exchanges are permitted post-dispatch. By placing an order, you explicitly acknowledge and accept this “factory-confinement” return policy.

4. Pricing, Payments & Taxes

All prices are quoted in USD (US Dollars) unless otherwise agreed. Prices exclude shipping, insurance, customs duties, VAT, or any other taxes imposed by the destination country. The Buyer is solely responsible for all import fees, tariffs, and local taxes. Payment terms: 30% deposit via wire transfer or letter of credit (L/C), 70% balance before shipment. For first-time clients, 100% prepayment may be required. Late payments incur interest at 1.5% per month. We reserve the right to suspend delivery until full payment is received.

5. Shipping, Risk of Loss & Delivery

Delivery terms are EXW (Ex Works) Jinan, China, unless otherwise specified in writing. Risk of loss and title pass to the Buyer upon the product leaving our factory premises. We are not liable for delays caused by customs, port congestion, natural disasters, strikes, or any force majeure events. Estimated delivery times are approximate and not guaranteed. Any shipping insurance must be purchased by the Buyer. Claims for damage during transit must be filed directly with the carrier; we provide necessary documentation but assume no liability after dispatch.

6. Warranty & Limitation of Liability

AgriTruck Supply provides a 1-year limited warranty on manufacturing defects for tractors, harvesters, and heavy machinery, effective from the date of factory dispatch. The warranty covers defective parts (excluding consumables, tires, batteries, hydraulic fluids) and remote technical support. The Buyer is responsible for local labor, freight for parts, and any import duties for replacement components. Our maximum aggregate liability under this warranty shall not exceed the original purchase price of the specific product. Under no circumstances shall we be liable for consequential damages, lost profits, crop losses, or any indirect harm arising from equipment use or downtime.

7. Intellectual Property & Website Use

All content on this website — including images, videos, logos, product designs, and text — is the exclusive property of AgriTruck Supply. You may not reproduce, distribute, or reverse-engineer any material without prior written consent. Unauthorized scraping, copying of product descriptions, or commercial use of our media is strictly prohibited and may result in legal action.

8. Limitation of Liability & Indemnification

To the fullest extent permitted by law, AgriTruck Supply, its directors, employees, or affiliates shall not be liable for any indirect, incidental, special, or punitive damages, including loss of revenue, profits, or data, arising from your use of our products or services. Our total cumulative liability for any claim related to these Terms shall not exceed the amount paid by you for the specific product giving rise to the claim. You agree to indemnify and hold us harmless against any third-party claims arising from your misuse of equipment or violation of local regulations.

9. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the People’s Republic of China, without regard to conflict of law principles. Any dispute arising from these Terms or your purchase shall be submitted to binding arbitration in Jinan, Shandong Province, China, administered by the China International Economic and Trade Arbitration Commission (CIETAC). The arbitration shall be conducted in English or Chinese at our option. You waive any right to participate in class actions or to bring claims in any other jurisdiction. For undisputed payment obligations, we reserve the right to seek injunctive relief in any competent court.

10. Modifications & Severability

We may revise these Terms at any time by posting an updated version on this page. Continued use of our Services after changes constitutes acceptance. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect.
